These Terms & Conditions govern your use of aprajita.art and any acquisition, commission, or other engagement with Aprajita Lal, the artist, and her studio (collectively, “the Studio,” “we,” “us,” or “our”). By using this website or purchasing or commissioning a work, you agree to these Terms. Please read them carefully.
1. Intellectual Property & Copyright
All artworks, images, designs, text, and other materials on this website are the original creations of Aprajita Lal and are protected by copyright and other intellectual property laws. The artist retains full and exclusive copyright in every work, in all forms and media, whether or not the physical artwork is sold.
Purchase of a physical artwork transfers ownership of that physical object only. It does not transfer copyright, reproduction rights, or any license to reproduce, adapt, or commercially exploit the work. All such rights remain with the artist unless expressly granted in a separate written agreement signed by the artist.
2. Reproduction & Reserved Rights
The artist reserves the right to reproduce, photograph, exhibit, and publish images of all works — including works that have been sold or commissioned — for archival, portfolio, educational, editorial, and promotional purposes. Collectors and other parties may not reproduce, scan, print, manufacture derivatives of, or use any work for commercial purposes without the artist’s prior written consent.
3. Use of Website Content
Content on this website is provided for personal, non-commercial viewing only. You may not copy, download, reproduce, or redistribute any content without the artist’s prior written permission. Any unauthorized use may constitute infringement of the artist’s rights.
4. Pricing, Availability & Orders
All prices are listed in the currency shown and are subject to change without notice. Each original artwork is unique; availability is not guaranteed until an order is confirmed and payment is received in full. The Studio reserves the right to refuse or cancel any order, including in cases of pricing errors or suspected fraud, and will refund any payment made in such cases.
5. Commissions
Commissioned works are created at the artist’s sole creative discretion. The artist will consider the collector’s preferences but retains full artistic control over composition, palette, materials, and execution. Specific terms for each commission are as follows:
- A non-refundable deposit (typically 50%) is required before work begins. This deposit reserves the artist’s time and covers materials.
- Estimated timelines are good-faith estimates, not guarantees, and may vary with the artist’s process, which can include extended curing periods.
- Reasonable variation between any preliminary concept and the finished work is inherent to original art and is not grounds for cancellation or refund.
- The balance is due upon completion and prior to delivery. Title and possession pass to the collector only after payment in full.
- The artist retains copyright and reproduction rights in all commissioned works, as set out in Section 1.
6. Payment
Payment is processed through our third-party payment providers. By placing an order, you confirm that you are authorized to use the payment method provided. Ownership of any work remains with the artist until payment has been received in full.
7. Shipping, Risk & Delivery
Shipping costs, methods, and timelines are confirmed at the time of purchase. While we package works with great care, transit times and conditions are outside our control once a work is handed to the carrier. The Studio is not liable for delays, loss, or damage occurring in transit; we recommend that collectors arrange appropriate insurance. Risk passes to the collector upon delivery to the carrier.
8. Returns & Cancellations
Each original artwork is a unique, handmade item created or selected specifically for the collector. All sales of original works and commissions are final and non-refundable, except where a work arrives materially damaged and the Studio is notified, with photographic evidence, within 7 days of delivery. In such cases, the Studio’s sole obligation, at its discretion, is repair, replacement (where possible), or refund of the purchase price. Commission deposits are non-refundable.
9. Care & Authenticity
Artworks may use mixed media, poured acrylics, inks, and resins that have natural variations in texture, finish, and color, and that may evolve subtly over time. These characteristics are inherent to the medium and are not defects. Care guidance is provided on request. Certificates of authenticity, where issued, remain the property record of the work and must accompany any future resale.
10. Resale & Moral Rights
The artist asserts her moral rights, including the right to be identified as the author of her works and the right to object to derogatory treatment of them. Collectors agree not to alter, modify, deface, or misrepresent a work, and to credit “Aprajita Lal” as the artist in any public display, loan, exhibition, or resale.
11. Limitation of Liability
To the fullest extent permitted by law, the Studio’s total liability arising from any work or from your use of this website shall not exceed the amount you paid for the relevant work. The Studio shall not be liable for any indirect, incidental, or consequential damages. Nothing in these Terms limits liability that cannot be excluded under applicable law.
12. Indemnity
You agree to indemnify and hold harmless the artist and the Studio from any claims, damages, or expenses arising from your misuse of any work, content, or this website, including any unauthorized reproduction or commercial use.
13. Governing Law
These Terms are governed by the laws applicable at the artist’s principal place of business, without regard to conflict-of-law principles. Any dispute shall be subject to the exclusive jurisdiction of the courts located there.
14. Changes to These Terms
We may update these Terms from time to time. The current version will always be posted on this page with its effective date. Continued use of the website or placing of an order after changes are posted constitutes acceptance of the updated Terms.
